In a word no, they are copyrighted.

If you would like some "pre-book" recipes,
http://beerdujour.com/JamilsRecipes.htm

and I'll add, you may not upload these to the BeerSmith recipe library.

Recipes cannot be copyrighted http://www.copyright.gov/fls/fl122.html

While BCS can and should fall under the realm of a cookbook, thus can be copyrighted, the recipe itself is not.

Correct me if I'm wrong here - I realize Beersmith may have had legal advice regarding this matter and I'm just interpreting the issue incorrectly.

This particular issue annoys me, frankly, because I purchased the book, I have the recipes, I just want them in a convenient format.  If there was a means to purchase said file, I would have no problem with that.  But, there isn't a commercial alternative so the next option is asking the share files with fellow homebrewers.
